These Terms of Service ("Terms") govern your access to and use of Notevio (the "Service"), operated by Andrei Ioan Rada ("we", "us"). By creating an account or using the Service you agree to these Terms.
1. Who you contract with
You are contracting with Andrei Ioan Rada, a sole trader. If you use the Service on behalf of an organization, you represent that you have authority to bind that organization. You must be of legal age in your jurisdiction to use the Service.
2. The Service
Notevio lets you upload study materials and generates AI-powered flashcards, MCQs, summaries, mnemonics, and adaptive practice. Features and limits depend on your plan (Free or Pro) and may evolve over time.
3. Your account
- Provide accurate information and keep it up to date.
- Keep your credentials confidential — you are responsible for activity under your account.
- Notify us of suspected unauthorized use.
4. Acceptable use
You must not:
- Use the Service unlawfully or to infringe intellectual property or privacy rights.
- Upload malware or content that is illegal, harmful, hateful, or sexually explicit involving minors.
- Attempt to probe, scan, scrape, or breach the security of the Service.
- Reverse engineer, resell, or redistribute the Service or circumvent technical limits.
- Use the Service to defraud, spam, or harass anyone.
5. AI outputs
- You are responsible for the prompts and content you submit and for how you use the outputs.
- AI outputs may be inaccurate, incomplete, or biased. Verify important information independently.
- Outputs are not medical, legal, financial, or other professional advice.
- You must have the necessary rights to any content you upload.
- We may filter, moderate, or refuse outputs, and suspend accounts that repeatedly infringe rights or violate these Terms.
6. Intellectual property
We retain all rights, title, and interest in the Service, including software, models, design, and branding. You retain ownership of content you upload; you grant us a limited, worldwide, royalty-free license to host, process, and display that content solely to provide and improve the Service.
7. Payments and subscriptions
Paid plans are sold and fulfilled by our reseller, Paddle. Prices, billing cycles, renewals, taxes, cancellations, and refunds are handled by Paddle in accordance with Paddle's Buyer Terms and our Refund Policy. Subscriptions renew automatically until cancelled; you can cancel at any time and will keep Pro access until the end of the current period.
8. Merchant of Record
Our order process is conducted by our online reseller Paddle.com. Paddle.com is the Merchant of Record for all our orders. Paddle provides all customer service inquiries and handles returns.
9. Service availability
The Service is provided "as is" and "as available". We do not guarantee that the Service will be uninterrupted, error-free, or that AI outputs will meet your requirements. To the fullest extent permitted by law, we disclaim all implied warranties, including merchantability and fitness for a particular purpose.
10. Suspension and termination
We may suspend or terminate your access for: material breach of these Terms, non-payment, security or fraud risk, or repeated or serious policy violations. You may stop using the Service and delete your account at any time. Upon termination, your right to use the Service ends and we may delete your data after a reasonable period.
11. Liability
To the maximum extent permitted by law, our aggregate liability arising out of or relating to the Service is limited to the fees you paid us in the 12 months preceding the event giving rise to the claim. We are not liable for indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or goodwill. Nothing in these Terms excludes liability that cannot be excluded under applicable law (e.g. fraud, death, or personal injury caused by negligence).
12. Indemnity
You will indemnify and hold us harmless from claims arising out of your content, your use of the Service in breach of these Terms, or your violation of applicable law or third-party rights.
13. Changes
We may update these Terms. Material changes will be notified through the Service or by email. Continued use after changes take effect constitutes acceptance.
14. Governing law
These Terms are governed by the laws of Romania. Disputes will be resolved by the competent courts of Romania, without prejudice to any mandatory consumer protections available in your country of residence.
